1. Agreement to Terms

By accessing or using the FlowFast services, websites, and applications (collectively, the "Service"), offered by FlowFast ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organization, you are agreeing to these Terms for that organization and promising that you have the authority to bind that organization to these Terms. If you do not agree to all of these Terms, do not access or use the Service.

2. Description of Service

FlowFast is a Software-as-a-Service (SaaS) platform that provides automated Domain-Driven Development tools. Our services include:

AI Data Modeler: An AI-powered tool that helps you iteratively design and evolve a data model.
Data Model Visualizer: A tool that generates Mermaid.js charts to visualize your data model.
Auto-Pilot Developer: An automated code generation service that creates ORM schemas, pushes schema changes to databases, seeds data, and generates tRPC code and Next.js pages with CRUD functionality.
FlowFast CLI: A command-line interface that you install on your machine to interact with our services.

3. Account Registration and Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. Payments, Billing, and Subscription Management

4.1. Merchant of Record

All payments for the Service are processed by Polar Software Inc ("Polar.sh"), our authorized Merchant of Record. By purchasing a subscription, you agree to Polar.sh's Terms of Service and Privacy Policy, which govern all payment processing and billing matters.

4.2. Subscription Plans and Resource Allocation

We offer the following subscription tiers:

Launch Pad: $79 USD/month for 600K tokens (~60 AI Calls). Perfect for solo developers launching their first project.
Growth Engine: $199 USD/month for 3M tokens (~300 AI Calls). For startups that need to ship fast and iterate faster.
Enterprise Turbo: $497 USD/month for 9M tokens (~900 AI Calls). For teams shipping enterprise-grade applications at startup speed.

4.3. Resource-Based Subscription Model

FlowFast operates on a resource-based subscription model where each Polar.sh subscription corresponds to a dedicated resource pool within our Service:

Launch Pad: Solo usage with 1.2M tokens (~120 AI Calls) - perfect for individual developers and side projects
Growth Engine: 2 team seats with 3M tokens (~300 AI Calls) - designed for startups and small teams
Enterprise Turbo: 3 team seats with 9M tokens (~900 AI Calls) - built for growing businesses and agencies

4.4. Resource Stacking and Multiple Subscriptions

Users may purchase multiple Polar.sh subscriptions to increase their resource capacity. When you have multiple active subscriptions:

AI Call resources stack: Multiple subscriptions combine to provide increased AI Call limits
Team seats accumulate: Additional subscriptions provide more team collaboration seats
Unified management: All subscriptions are managed through a single FlowFast account
Automatic account linking: New Polar.sh subscriptions are automatically linked to your existing FlowFast account, or a new account is created for first-time subscribers

Important: Resource Stacking Applies Only to Subscriptions You Own

Resource stacking only occurs when you personally own multiple subscriptions. If you are a team member on someone else's subscription, purchasing your own subscription will create a separate resource pool. Your personal subscription does not increase the resources available on the team subscription you are a member of - it only increases resources for subscriptions you own and manage directly.

4.5. 30-Day Money-Back Guarantee

We stand behind our Service with a 30-day money-back guarantee. If you are not completely satisfied with FlowFast within the first 30 days of your subscription, you may request a full refund, no questions asked.

To be eligible for a refund, you must request it within 30 days of your initial purchase. After processing your refund, your subscription will be canceled, and you will lose access to the Service immediately.

4.5.1. Protection Against Abuse and Good Faith Usage

The 30-day money-back guarantee is offered in good faith to allow customers to evaluate whether our Service meets their needs. It is not intended for abuse, commercial exploitation, or as a means to obtain free development work.

Important: Protection Against Guarantee Abuse

We reserve the right, in our sole discretion, to deny refund requests and/or immediately terminate accounts if we detect usage patterns consistent with bad faith or abuse, including but not limited to:

Consuming a significant portion (e.g., 50% or more) of the subscription tier's allocated AI Calls or other resources and then requesting a refund.
Signs of automated or scripted usage aimed at generating large volumes of code or data models in a short period.
Submitting a refund request immediately after generating a substantial, usable codebase for a project.
Creating multiple accounts to circumvent this policy or to obtain multiple refunds.
Any usage that appears aimed at commercial exploitation of the refund policy rather than good-faith evaluation of the service.

In such cases, we may determine that you have received measurable value from the Service, and your refund request will be denied. By using the Service, you acknowledge that the determination of "abuse" or "bad faith" is at our reasonable discretion.

4.5.2. Subscription Stacking During Trial Period

We encourage customers who discover value in our Service to upgrade their subscription tier or purchase additional subscriptions to access more resources. However, the 30-day money-back guarantee is designed for genuine evaluation purposes.

Important: Subscription Stacking Demonstrates Recognized Value

If you purchase multiple subscriptions (subscription stacking) during your first 30 days and subsequently request refunds for all or most of these subscriptions, we reserve the right to deny such refund requests. Subscription stacking demonstrates that you have recognized sufficient value in our Service to warrant additional investment, and attempting to obtain refunds after such demonstrated commitment constitutes bad faith usage.

This policy does not apply to tier upgrades within the same subscription (e.g., moving from Launch Pad to Growth Engine), but specifically to purchasing multiple separate subscriptions to accumulate resources.

4.6. Subscription Status and Immediate Access Termination

Your access to FlowFast services is directly tied to your subscription status with Polar.sh. We maintain a strict policy regarding subscription status and service access:

Active Subscription Required: You must maintain an "active" subscription status with Polar.sh to access the resources allocated to your account.
Immediate Access Termination: If your Polar.sh subscription status changes to anything other than "active" (including but not limited to: paused, cancelled, expired, or payment failed), you will immediately lose access to all FlowFast services and resources associated with that subscription.
No Prorated Access: We do not provide prorated access or "days remaining" if you cancel your subscription early. Service access terminates immediately upon subscription cancellation or status change.
Merchant of Record Responsibility: All payment processing, billing disputes, subscription management, and refund requests are handled exclusively by Polar.sh as our Merchant of Record. FlowFast is not involved in payment processing and cannot address billing-related inquiries.

Important: Subscription Status Determines Service Access

By using our Service, you acknowledge and agree that your access to FlowFast is contingent upon maintaining an "active" subscription status with Polar.sh. Any subscription status change will result in immediate service termination. All billing matters must be directed to Polar.sh support through their designated support channels.

4.7. Billing and Cancellation

Subscription fees are billed in advance on a monthly basis. You may cancel your subscription at any time through your Polar.sh account dashboard or customer portal. As stated above, cancellation will result in immediate termination of service access. No partial refunds are provided for mid-period cancellations after the initial 30-day guarantee period.

4.8. Billing Support

For any payment-related issues, including billing inquiries, cancellations, subscription status questions, or refund requests, you must contact Polar.sh Support directly through their official support channels. FlowFast cannot handle payment or billing matters directly as Polar.sh acts as our Merchant of Record.

5. Acceptable Use

You agree not to use the Service:

For any illegal or unauthorized purpose.
To violate any laws in your jurisdiction.
To generate malicious, fraudulent, or infringing content.
To interfere with or disrupt the integrity or performance of the Service.
To attempt to reverse engineer, decompile, or extract the source code of our software.

6. Intellectual Property

6.1. Our IP

FlowFast retains all rights, title, and interest in and to the Service, including all related intellectual property rights.

6.2. Your IP

You retain all rights to the data models, code, and other content you generate or input into the Service ("Your Content"). By using the Service, you grant us a limited license to use Your Content solely for the purpose of providing the Service to you.

7. AI Services and Third-Party Models

Our Service utilizes Large Language Models (LLMs) via In-Context Learning (ICL) to provide functionality. You understand and acknowledge that:

AI-generated outputs are probabilistic and may not be accurate, complete, or free from errors.
We do not guarantee the output of any AI-generated content.
You are solely responsible for reviewing, validating, and testing all generated code and data models before use in a production environment.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL FLOWFAST, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.

10. Termination

We may suspend or terminate your access to the Service immediately, without prior notice or liability, if you breach these Terms. Upon termination, your right to use the Service will cease immediately.

11. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of changes by updating the "Last Updated" date. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which FlowFast operates, without regard to its conflict of law provisions.
